Important Compliance Requirements
To write content in the CBD niche is both an art and a science. There are exacting requirements set out by the MHRA on what can and can’t be covered and this needs to be combined with an interesting, engaging approach that is useful to prospective buyers. Some limitations include:
Any medical claims or inferences are not permitted because CBD is sold legally as a food supplement only. This means that you cannot make medical claims or suggest use as a treatment without a licence. This includes referencing the traditional use of cannabis as a medicine or using the term ‘medicine’ presents a non-medical product as medicinal, which requires a licence. It is also not permissible to link to any statistics or studies citing the benefits or uses of CBD.
As a food supplement, you cannot make a statement such as ‘CBD helps with health conditions’, CBD cannot restore, modify, enhance or promote any bodily function or state. It is also not permissible to make reference to any potential health risks that may arise as a result of not taking CBD. It is permissible to refer to the product’s ability to support and/or maintain health and wellness.
When suggesting a relationship between CBD and the Endocannabinoid System (ECS), it is not permitted to refer to any specific functions, nor is it permissible to refer to the role of the ECS. Health claims are only permissible if they have been authorised and approved by the EFSA as per regulation (EC) 1924/2006. Currently, CBD has no approved health claims.
Many companies label their CBD products as ‘organic’ when, in fact, they are not. In order to market a product as ‘organic’, it needs to have been certified by an authorised third-party lab. Many CBD products are produced organically but have not been certified. In these cases, the products should be labelled and promoted as ‘organically grown’.
CBD for Pets
Under the guidelines set by the Veterinary Medicines Directorate (VMD), it is no longer legal to buy or dispense CBD for pets without a prescription. CBD companies cannot sell, market, or suggest use without the relevant license.
CBD isolate can only be used in vapes and cosmetics in the UK. As per the restrictions set out by the EU’s Novel Food Regulation, CBD sellers cannot suggest the use of CBD isolate in oral products. Note that customers can use CBD isolate orally, but a company may not sell, market, or suggest oral use.
The current legal level of THC in the European Union is 0.2% in the growing plant.
Industrial hemp from which CBD is extracted is not exempt from the Misuse of Drugs Act 1971. The only parts of the plant that are non-controlled are the stems and the stalk of the mature plant once it has been separated from the plant. Everything else is classified as cannabis, and as such, it is a Class B drug, whether it is hemp or marijuana. This includes the flower/bud irrespective of the level of THC. In the EU, the use of hemp flowers is permitted.
It is customary to see reviews on CBD websites, and it’s something that clients rely on to make purchase decisions, but not all companies can use review facilities. If customers leave reviews on the website that feature medicinal claims, they cannot be published. If companies are not able to moderate the reviews, then they cannot be linked to or referenced. This includes independent third-party websites such as Trustpilot. These requirements are strictly enforced by the MHRA who use reviews in their determination process.
